On May 29, 2023, a panel of the Inquiry Committee approved a Consent Agreement between BCCNM and Samantha Joyce Ballesteros of Burnaby to address practice issues that occurred in June 2022 related to using a personal mobile device to take images of four pages of a document containing confidential information of 114 residents of a long-term care facility. The registrant had no work-related purpose for obtaining the information. Further, the registrant breached an undertaking and failed to cooperate with the regulator during the investigation.
The registrant has voluntarily agreed to terms equivalent to a limit and/or condition on their practice, including:
- A suspension of their nursing registration for three weeks.
- A public reprimand.
- Remedial education in Ethics, Privacy, Responsibility, and Accountability.
- A regulatory practice consulting program to address the foundational issues underpinning this agreement.
The Inquiry Committee is satisfied that the terms will protect the public.
